Privacy Policy

Welcome to ShayaNYC.com (the “Site”).

This Privacy Policy discloses the privacy practices of www.ShayaNYC.com and applies to information collected through the Site. The primary focus of this Privacy Policy is non-public information about the identity of our online customers and web visitors in the United States. Where applicable, we will comply with the laws of other countries that contain mandatory requirements that differ from this policy.

What We DON’T Do

We do not collect or use sensitive information for purposes other than those described in this Privacy Policy unless we have obtained your prior consent.  We do not sell, trade or share information you provide to us with anyone outside of our company or with anyone not authorized to represent us to offer our products or to perform functions on our behalf, except as may be required by law or authorized by you.  Unless you request it, we do not provide personal information to third parties for the marketing of their products and services without your consent. We do not target children for the collection of information online and do not knowingly collect personal information from anyone under the age of 18.

What We DO

We are committed to respecting and protecting your privacy. Therefore, this Privacy Policy identifies (1) the types of information we may collect, (2) how we use it, (3) the steps we take to protect it, and (4) how you can control its use.

(1) The Types of Information We Collect

We collect information you give us.  When you purchase a product or sign up to become a reseller of our products, we ask you to provide personal information. This includes information such as your name; address; e-mail address; telephone number; billing, payment, credit, and transaction information (including without limitation credit card numbers, account numbers, and/or taxpayer identification numbers); and demographic information.   All such information is gathered through a secure server.  We do not retain credit card information on file.

In addition, when web visitors access the Site we automatically receive certain “web usage” information.  We may collect other web usage information, such as the web pages the browser visits on the Site, the amount of time spent on such web pages, and whether the browser re-visits the Site.  We may use web usage information to facilitate and enable the functioning of the Site and to expand and improve our web visitors’ online experience. We may also aggregate such web usage information with other visitors’ web usage information to assess trends and better design, monitor and otherwise improve the Site, as well as to streamline our marketing efforts.

We may also collect information from other sources as, for example, our distributors.  Finally, if you opt-in to our Site, we will use your email address and other information you provide to notify you of new products, promotions and news about our company.

(2) How We Use the Information We Collect

We will use your information to respond to your queries or to send information you have requested. If you have set up a reseller’s account, we will use the information to establish and service your account.  This information is used for billing purposes and to fill your orders. We may use this information to provide, confirm, change, bill, monitor and resolve problems with our products and services. We may also use the information of a customer or web visitor to develop, market and sell our products and services.

Unless you ask us not to, we may contact you via email in the future to tell you about specials, promotions, company news, new products or services, or changes to this privacy policy.  Every marketing e-mail we send contains instructions and an opt-out link that will allow you to stop additional e-mails.

We share information with third parties where required to provide our products and services. For example, we may disclose your name, telephone number and address to a distributor who services your region if you have asked us to provide information to you about carrying our products.  Other examples include shipping companies who deliver our products and web site development or advertising companies who provide web design, analysis and advertising services. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

We may sometimes aggregate the personal information of different customers or web visitors to produce data about a group or category of products, customers or web visitors. For example, we might use aggregate data about customers who have purchased our products in order to extend special offers, discounts, promotions, etc.  In this case, such aggregate data will not disclose or reflect any personal information of any specific customer or web visitor.

(3) Steps We Take to Protect the Information We Collect

Information security – We restrict access to personal information to our employees, contractors and agents who need to know that information in order to operate, develop or improve our services (for example, shipping orders, accounting, etc).  We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include physical security measures to guard against unauthorized access to systems where we store personal data.

Data integrity – We process personal information only for the purposes for which it was collected and in accordance with this Privacy Policy.  We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete and current, but we depend on our users to update or correct their personal information whenever necessary.

In normal circumstances, we do not share your personal information.  There are certain limited circumstances, however, when we may share personal information.  The first would be in cases where we have your consent.  Second would be cases in which we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Use, including investigation of potential violations thereof, or (c) protect against imminent harm to the rights, property or safety of our company or the public as required or permitted by law.

(4) How You Can Control the Use of Information We Collect

We honor requests from customers and web visitors to review their personal information. We make good faith efforts to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes (like income tax reporting). You may verify that appropriate corrections have been made via email or by contacting a company representative. You may request to be removed from our lists at any time either by email or by contacting one of our representatives.

A Word About Cookies and Web Beacons

A cookie is a piece of data that a web server sends to your computer when you visit a web site to uniquely identify your browser. Cookies can contain a variety of information, such as a simple count of how often you visit our Site or information that allows us to customize the Site for your use.  Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Web beacons (also known as “clear gifs” or “one-pixel gifs”) are small graphic images on a web page or in an e-mail that allow us to monitor the activity on the Site or to make cookies more effective.  We may use web beacons in certain of our web pages and e-mails to gauge the effectiveness of our marketing campaigns and e-mail correspondence. For example, we may use web beacons in our HTML-based e-mails to let us know which e-mails have been opened by the recipients.  These web beacons assist us in measuring the effectiveness of our e-mails, and will not be used for any other purpose.

Changes To This Policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent, and we expect most such changes will be minor. We will post any changes on this page. Other/Affiliated Sites – This Privacy Policy applies to websites that are owned and operated by our company. We do not exercise control over other websites that display our products or may be linked to our website.
